What is the West Virginia Lemon Law?

The West Virginia lemon law protects the consumer from defects in motor vehicles that substantially impair its use, value, or safety. Generally speaking, if the vehicle has been repaired 2 to 4 times for the same defect within the warranty period and the defect has not been fixed, the car qualifies as a Lemon. West Virginia Lemon Law Summary

Vehicles Covered

Passenger vehicles, pickup trucks, vans and motor home chassis used primarily for personal, family, or household purposes.

Repair Interval

Three (3) repair attempts of 30 calendar days out of service. 1 attempt for a condition likely to cause death or serious bodily injury.

Coverage Period

Warranty period or 1 year.

Often times, your new car isn't expected of being a Lemon until it is too late (out of

warranty, over the mileage, etc.). If you keep a record of every repair visit, starting with the first one, you will protect your rights under the Consumer Laws. Document everything, including who you talk to, what is said, dates and times.
