What is the South Dakota Lemon Law?

The South Dakota lemon law protects the consumer from defects in motor vehicles that substantially impair its use, value, or safety.  Generally speaking, if the vehicle has been repaired 2 to 4 times for the same defect within the warranty period and the defect has not been fixed, the car qualifies as a Lemon.  All states differ, so consult our South Dakota Summary  below.  Please be aware that the warranty period may not coincide with the Manufacturer's Warranty.

  Vehicles Covered

All vehicles intended primarily for use and operation on the public highways which is self-propelled.  Does not include motor homes or vehicles with a GVW of 10,000 pounds or more.

    Repair Interval

Four (4) repair attempts plus 1 final attempt.

                   Coverage Period

1 year or 12,000 miles.

Often times, your new car isn't expected of being a Lemon until it is too late (out of
warranty, over the mileage, etc.).  If you keep a record of every repair visit, starting with the first one, you will protect your rights under the Consumer Laws.  Document everything, including who you talk to, what is said, dates and times.
